The Ministry of Industry and Trade has recently issued Decision No. 1514/QD-BCT applying anti-circumvention measures to trade remedies for a number of cane sugar products imported from Cambodia, Indonesia, Laos, Malaysia and Myanmar.
The decision to apply anti-circumvention measures is issued on the basis of an objective and transparent investigation process in accordance with domestic laws and international commitments. The main contents of the investigation conclusions have been sent in advance to relevant state management agencies as well as enterprises for comments.
On the basis of collecting and synthesizing information and opinions provided by stakeholders, including information from the domestic manufacturing industry, foreign manufacturing and exporting enterprises, importing enterprises and from According to the competent authorities, the investigation concluded to determine the use of sugar materials originating from Thailand to produce and export a number of cane sugar products to Vietnam by enterprises from Cambodia, Indonesia, Laos, Malaysia and Myanmar is an act of evading anti-dumping and anti-subsidy measures applied to Thai sugar products.
At the same time, economic indicators show that the effectiveness of anti-dumping and anti-subsidy measures for cane sugar products originating from Thailand is currently being reduced due to the impact of sugar imported from 5 countries above mentioned.
The Ministry of Industry and Trade emphasized, in order to ensure a fair competitive environment between domestically produced goods and imported goods, to protect the legitimate interests of the domestic industry and farmers growing imported sugar cane and sugarcane. Imports from Cambodia, Indonesia, Laos, Malaysia and Myanmar using Thai sugar materials will be subject to the same anti-dumping and anti-subsidy tax rates applied to Thai sugar with a total tax rate of 47.64 %, of which anti-dumping tax is 42.99% and anti-subsidy tax is 4.65%. Sugar imported from 5 countries, if proven to be produced from sugarcane harvested in these countries, will not be subject to anti-circumvention measures.
Measures against circumvention of trade remedies will take effect 7 days after the Decision is issued until June 15, 2026, unless it is changed or extended according to other decisions of the Ministry of Industry and Trade. Interested parties can submit a request to the Ministry of Industry and Trade to review the application of anti-circumvention measures on the basis of the provisions of Articles 82 and 90 of the Law on Foreign Trade Management and Chapter IV Decree No. 10/2018/ND-CP detailing a number of articles of the Law on Foreign Trade Management on trade remedies.
In the coming time, the Ministry of Industry and Trade will continue to coordinate with the Ministry of Agriculture and Rural Development, the General Department of Customs and related agencies to monitor the impact of trade remedy measures, production, supply, demand, price... to deploy appropriate management tools according to regulations in order to ensure a fair, equal and harmonious competitive environment for benefits between sugarcane farmers and businesses sugar producers, sugar consumers and consumers.
